LetterSnack is a Software-as-a-Service (SaaS) platform designed for parents and guardians to receive personalized, AI-generated summaries of school communications from connected Gmail accounts. The service provides digestible information through a user-friendly dashboard, offering features such as quick actions, calendar integration, multi-child profile management, and subscription-based access to premium functionalities. By using LetterSnack, you agree to these Terms and Conditions ("Terms").

User Accounts

Eligibility: You must be at least 18 years old and have the legal capacity to enter into these Terms to use LetterSnack. The service is not intended for use by children under 13, and LetterSnack does not knowingly collect personal information from children under 13 in compliance with the Children’s Online Privacy Protection Act (COPPA).

Account Creation: To access LetterSnack, you must create an account using Google authentication and grant Gmail OAuth permissions. You agree to provide accurate, complete, and current information during account creation and to update such information as needed to maintain its accuracy.

Account Security: You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to notify LetterSnack immediately at support@lettersnack.com if you suspect any unauthorized access or use of your account. LetterSnack is not liable for any loss or damage arising from your failure to safeguard your account.

Subscription & Payment

Subscription Tiers:
Free Plan: Limited to 1 child profile, 1 email domain, 4 monthly digests, basic content personalization, and basic email support. No payment required.
Trial Plan: 4-week free trial with full access to Premium features (1 child profile, 1 email domain, unlimited digests, quick actions, full personalization, trial support). No credit card required.
Premium Plan: Up to 4 child profiles, 10 email domains, unlimited digests, quick actions, full personalization, and priority support for $5/month or $50/year.

Payment Terms: Payments for the Premium plan are processed securely via Stripe. By subscribing, you authorize LetterSnack to charge the applicable fees to your provided payment method. All fees are non-refundable except as required by applicable law. You are responsible for any applicable taxes associated with your subscription.

Subscription Changes and Cancellation: You may upgrade, downgrade, or cancel your subscription at any time through the LetterSnack dashboard. Upon downgrading or canceling, you will retain access to your current plan’s features until the end of the billing cycle. No data will be lost due to plan changes. LetterSnack reserves the right to modify pricing at any time, with notice provided to active subscribers at least 30 days before changes take effect.

Acceptable Use

You agree to use LetterSnack only for its intended purpose and in compliance with all applicable laws and these Terms. Prohibited activities include, but are not limited to:

- Attempting to gain unauthorized access to LetterSnack’s systems or networks.
- Using the service to violate any laws, including those related to privacy, data protection, or intellectual property.
- Submitting or processing content that is unlawful, defamatory, or infringing on third-party rights.
- Attempting to disrupt, overload, or impair the functionality of LetterSnack.
- Using the service for unauthorized commercial purposes or reselling access to the service.

User Content

Ownership and License: You retain ownership of any content you submit to LetterSnack, including child profile information and connected email data ("User Content"). By submitting User Content, you grant LetterSnack a worldwide, non-exclusive, royalty-free, transferable license to use, process, store, and display such content as necessary to provide and improve the service. This license terminates when you delete your account, except for anonymized data used for service improvements.

Responsibility: You are solely responsible for ensuring that you have the necessary rights to submit User Content and that such content complies with these Terms and applicable laws. LetterSnack is not responsible for the accuracy, legality, or appropriateness of User Content.

Intellectual Property

All content, trademarks, logos, and software on LetterSnack, excluding User Content, are the property of LetterSnack or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the service without prior written permission from LetterSnack.

Termination

By You: You may terminate your account at any time by contacting support@lettersnack.com or using the account deletion feature in the dashboard. Upon termination, your data will be securely deleted, subject to applicable laws and anonymized data retention for service improvements.

By LetterSnack: LetterSnack reserves the right to suspend or terminate your access to the service at its sole discretion, without notice, for reasons including but not limited to:
- Violation of these Terms.
- Conduct harmful to other users, LetterSnack, or third parties.
- Failure to pay subscription fees.
- Inactivity for 12 months or more.

Upon termination, your access to the service will cease, and any unpaid fees remain due.

Privacy and Security

Data Protection: LetterSnack employs industry-standard security measures to protect your data, including encryption and secure authentication protocols. Your Gmail data is accessed solely to process school communications and is not used for any other purpose.

Children’s Privacy: LetterSnack prioritizes children’s privacy and complies with COPPA. No personal information is knowingly collected from children under 13, and child profile data is used only to personalize content for parents or guardians.

Data Sharing: LetterSnack does not sell personal information to third parties. Data may be shared with service providers (e.g., Stripe for payments) solely to facilitate the service, subject to strict confidentiality agreements.

Limitation of Liability

To the fullest extent permitted by law, LetterSnack and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, profits, or business opportunities. LetterSnack’s total liability for any claim will not exceed the amount paid by you for the service in the preceding 12 months.

Disclaimer of Warranties

LetterSnack is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. LetterSnack does not guarantee that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

Modifications to Terms

LetterSnack may update these Terms at any time. You will be notified of material changes via email or through the LetterSnack dashboard. Continued use of the service after such changes constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of LetterSnack will be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Miscellaneous

Entire Agreement: These Terms, along with the Privacy Policy, constitute the entire agreement between you and LetterSnack regarding the service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Assignment: You may not assign your rights under these Terms without LetterSnack’s prior written consent. LetterSnack may assign its rights without restriction.
Force Majeure: LetterSnack is not liable for delays or failures in performance due to events beyond its reasonable control, such as natural disasters or internet outages.
